USER AGREEMENT

on the procedure for using the mobile application
1. General Provisions
1.1. This User Agreement (hereinafter referred to as the “Agreement”) defines the terms of use of the GoGym mobile application (hereinafter referred to as the “Application”) and regulates the rights and obligations of the Administration and Users.
1.2. The Application is a marketplace for searching, booking, paying for, and providing sports services between Clients, Coaches, and Sports Facilities.
1.3. Registration and use of the Application confirm the User’s acceptance of the terms of this Agreement and the Privacy Policy.
1.4. Application Administration: Sole Proprietor “TITAN”, email: devs@gogym.kz, is the owner of the Application and ensures its functioning.
2. Terms and Definitions
2.1. User — any individual or legal entity registered in the Application.
2.2. Client / Athlete — an individual who orders and pays for services.
2.3. Coach / Instructor — an entrepreneur providing sports services.
2.4. Sports Facility — an organization or entrepreneur providing sports services and facility rental services.
2.5. Account — the User’s account in the Application.
2.6. Balance — the User’s internal account reflecting funds available for payments within the Application.
2.7. Commission — remuneration of the Administration in the amount specified in the Application, charged from each successful transaction.
2.8. Bonuses — internal reward currency of the Application used to incentivize Clients.
3. Registration and Account
3.1. To use the Application, the User must register and create an Account by providing accurate and reliable data.
3.2. Minors (under 18 years of age) may use the Application only through a legal representative.
3.3. Coaches and Sports Facilities are required to confirm their business status (sole proprietor / LLP) and provide necessary documents upon request of the Administration.
3.4. The User is responsible for the security of their account data and undertakes not to transfer it to third parties.
4. User Rights and Obligations
4.1. The User is prohibited from:
– posting false information;
– violating the rights of other Users;
– creating duplicate accounts;
– engaging in fraudulent activities;
– using the Application for unlawful purposes.
4.2. The User has the right to:
– use the Application’s functionality for its intended purpose;
– receive bonuses for activity;
– leave reviews and participate in ratings;
– contact support to resolve issues.
5. Payment Procedure
5.1. All payments for services are made through the Application’s payment systems. A commission is deducted from each successful payment made to a Coach or Sports Facility.
5.2. Bonuses are awarded to Clients for service payments, reviews, recommendations, and activity. Bonuses may be used for partial payment of services within the Application (up to 30%).
5.3. All transactions between participants are recorded in the Application and can be viewed in the User’s personal account.
6. Refund Policy
6.1. Refunds are possible in the following cases:
– cancellation of the service by the Coach or Sports Facility;
– technical failure that made it impossible to receive the service;
– closure of the Sports Facility for more than 14 days.
6.2. Refund at the initiative of the Client:
Single (1 pc.) training in all formats: individual, personal, group, open day.

Once training has started or is completed, no refunds are possible.

Once training has started or is completed, no refunds are possible.
6.3. All refunds are credited to the Client’s internal account, with the possibility of withdrawal or reuse within the Application.
7. Ratings and Reviews
7.1. Users have the right to leave reviews about Coaches, Sports Facilities, and Clients.
7.2. Reviews affect the overall rating, which is taken into account when displaying profiles and promoting services within the Application.
7.3. The Administration reserves the right to remove reviews that violate the Application rules (including insults, false information, or spam).
8. Limitation of Liability
8.1. The Application Administration does not provide sports services and is not responsible for their quality, safety, or compliance with User expectations.
8.2. Coaches and Sports Facilities are solely responsible for the services they provide.
8.3. The Administration is not responsible for any losses incurred by Users as a result of actions or omissions of other Users.
8.4. In case of disputes between Users, the Administration may act as a mediator but is not obligated to participate in dispute resolution.
9. Personal Data
9.1. The User agrees to the processing of their personal data for the purposes of Application operation, service promotion, and compliance with applicable law.
9.2. The Administration undertakes to ensure confidentiality and protection of personal data in accordance with the Law “On Personal Data”.
10. Amendments to the Terms
10.1. The Administration has the right to amend this Agreement at any time, with mandatory notification of Users via the Application.
10.2. Continued use of the Application after publication of a new version of the Agreement constitutes full acceptance of the updated terms.
11. Final Provisions
11.1. This Agreement remains valid indefinitely while the User uses the Application.
11.2. All disputes shall be resolved through negotiations, and if not resolved, in court at the place of registration of the Application owner.
